 State-Bar-Thumb State Bar Seeks Public Comment on Amending California's Legal Malpractice Insurance Rules

The State Bar is seeking public comment on options under consideration as part of its statutorily mandated malpractice insurance study. The deadline to submit public comment is November 5, 2018. Currently, malpractice insurance is not required for attorneys licensed in California. However, attorneys without this insurance are required to disclose this fact to clients for whom legal representation will exceed four hours.

The Los Angeles County Bar Association ratings of judicial candidates seeking election to the Los Angeles Superior Court on November 6 are AVAILABLE HERE. Each of the candidates are rated on a number of factors, including character, experience, and knowledge of the law, to determine their qualifications to serve on the bench.

We hope that you have often had the opportunity to attend programming or other events at LACBA’s downtown offices at 1055 West 7th Street, where we currently occupy the 26th and 27th floors. This has been our professional home since 2009. The world has changed in the intervening nine years and so has LACBA! We are in the midst of efforts to improve the efficiency of your association, and that includes better utilization of our staff, including relying on remote workers for many of our call center-based departments. These efficiencies create the opportunity to sublease our extra space at headquarters. 

We expect to consolidate the physical staff to one floor by the end of this year, or early 2019, and are excited to offer either half of our 27th floor (9,000 square feet) or the majority of our 26th floor (19,000 square feet) for sublease at a below market rate. The sublease could last as long as the master lease, which ends March 31, 2026. Please contact our Chief Financial Officer Bruce Berra at with any questions or if you’d like to see the available space. 

We are excited to transition some of our staff to a remote work model that better serves the needs of our members and will result in a smaller physical footprint for LACBA, while maintaining the same positive member experience. Thank you for your membership and support as we continue building a better bar for all!

 Armed-Forces-Committe-Thumb For Veterans Day, the Armed Forces Committee Honors Steve Morgan on his Safe Return from Iraq
The Armed Forces Committee is one of the few legal committees whose members have regularly deployed to combat zones, and the AFC is proud to welcome home Major Steve Morgan from his tour of duty with the U.S. Army in Iraq. And this is Steve Morgan’s second tour.  Back in 2009-2010, Steve deployed to Baghdad to replace a certain Major Adam Siegler, who was then finishing up his tour in Iraq, and is now an attorney at Greenberg Traurig and the AFC’s current Chair. During the same period, Navy Lieutenant James Santiago, an attorney at Gibson Dunn and current AFC member, was flying an F-18 fighter in close air support missions over Afghanistan. After Steve’s return from his first tour, he became one of the founding members of the AFC and was its very first Vice Chair, before becoming the AFC Chair.

Justin is a highly decorated veteran of the United States Army who committed five years to service, which included deployment to Iraq, before his honorable discharge in 2012. Upon his return from service, he received numerous traffic tickets that he found himself unable to manage due to his struggles with unemployment, homelessness, disability and his reliance on fixed disability benefits as his only source of income. Unable to pay the tickets, he had little hope that he would ever overcome his circumstances.

LACBA Counsel for Justice and the Domestic Violence Legal Services Project (DVP) would like to thank each of the volunteers, firms, and organizations who contributed to the success of #LACBA_DVP #31DaysofAwareness social media awareness campaign. Through their efforts, we raised more than $33,000 to support DVP’s work with domestic violence victims at the Stanley Mosk Courthouse in downtown Los Angeles in conjunction with October as Domestic Violence Awareness Month.

 alsp-logo AIDS Walk Recap 2018—You Have Until November 16 to Donate
Nearly $7,000 Raised to Date

Over a dozen Counsel for Justice Board and LACBA members and their families turned out for the October 21st AIDS Walk in downtown Los Angeles to support the CFJ AIDS Legal Services Project. Eighty percent of the proceeds raised will go to support pro bono legal services for people living with HIV, like RB.

“RB” is a 55-year-old, long-time survivor of HIV and Stage 4 cancer.  She walks with a cane and often needs a wheelchair to get around.  Dreading an upcoming surgery and needing extra help at home, RB asked her landlord for permission to add a tenant as a government sponsored live-in aide. The landlord responded to RB’s request by giving her a 60-Day Notice to Vacate. 

Thanks to the assistance of her pro bono team, RB received a $12,000 settlement check and the landlords were ordered to attend four years of landlord and anti-discrimination training.

I once fifth-chaired a trial against an experienced lawyer who gave several gripping press conferences. I watched the interviews in fascination, anger, and horror (in that order) as the lawyer cleverly spun her client's tale. Ultimately, the jury ruled in her client's favor. While I do not believe that the jury was affected by the lawyer's statements to the media (she had facts and law on her side), I witnessed firsthand the potent power of trial publicity.
