No On 66 Thumbnail LACBA Urges No Vote on Proposition 66
LACBA's Board of Trustees has adopted a resolution opposing Proposition 66—DEATH PENALTY. PROCEDURES. INITIATIVE STATUTE—which will appear on the November California Ballot. If enacted, this measure would require the Courts of Appeal to hear death penalty appeals in the first instance and the California Supreme Court to decide all death penalty appeals within five years, further straining court resources and potentially delaying thousands of civil and criminal non-death penalty cases each year. LACBA is not taking a position on the fundamental issues concerning the death penalty: its effectiveness, moral concerns, or its societal merits.

Twice per month for the last 18 months, Kathryn has prepared Temporary Restraining Order petitions at the busiest pro bono TRO clinic in California-LACBA’s Domestic Violence Legal Services Project. She says, “I feel obligated to give back to the community and I feel very fortunate to be able to do so in such a meaningful way." In addition to being steady and reliable, when the clinic is short-handed, Kathryn rearranges her schedule to make herself available to the battered and bruised. DVP thanks her for her professionalism and compassion.
Cente rFor Mediation Logo LACBA Civic Mediation Project Peer Mediation Refresher Training Recap

“Just as reading and writing are essential skills for leading a productive life, so too are conflict resolution skills. Young people need to be able to communicate effectively, appreciate the consequences of their actions, generate and evaluate alternative solutions to problems, and co-exist with people with whom they disagree. Peer mediation teaches these fundamental skills and attitudes to both mediators and parties.”  (Students Resolving Conflict: Peer Mediation in Schools, Richard Cohen)

magnify_1115 When is Production of a Privileged Document Inadvertent?
Document production in litigation often involves massive numbers of documents, and established California law recognizes that the inadvertent inclusion of privileged documents in that context should not automatically be deemed a waiver of privilege. Much has been written about the duty to stop review and notify the privilege holder, as imposed by the trio of California cases, State Compensation Ins. Fund v. WPS, Inc. (State Fund),2  Rico v. Mitsubishi Motors Corp. (Rico),3  and Clark v. Superior Court (Clark).4
