LACBA Mourns Passing of Judge Arthur Alarcón 

The Los Angeles County Bar Association is saddened by the passing of the Honorable Arthur L. Alarcón, Senior Circuit Judge of the U.S. Court of Appeals for the Ninth Circuit, at 89 years of age. Judge Alarcón was the recipient of LACBA’s 2014 Outstanding Jurist Award in recognition of his life-long and significant contributions to the bench, the practice of law, and the community at large. His influence was felt far beyond the courtroom as he made it his mission to counsel and promote the careers of young lawyers, to push for equality both inside and outside of the courtroom, and to provide for the betterment of the community. Judge Alarcón will be greatly missed by his family and friends including the LACBA community. In lieu of flowers, Judge Alarcón’s family requests that donations in his name may be made to the LACBA Veterans Project.



Domestic Violence Project: Big Guys Need Help, Too
  
One in seven men aged 18 and older in the United States have been the victim of severe violence by an intimate partner in their lifetime. In December 2014, Quincy, 23 years old, walked into the LACBA Domestic Violence Project, located at Stanley Mosk Courthouse. He was a big guy, over 6’ tall and 225 pounds, and looked like a man who could take care of himself. His ex had been violent before—an occasional thrown remote control or phone, a slap now and then, some angry kicking, but never an outright attack. He didn’t realize that violence oftentimes escalates. (more)


LACBA’s Center for Civic Mediation Joins Counsel for Justice
  
The Los Angeles County Bar Association’s Center for Civic Mediation (Center) has completed its merger with Counsel for Justice (CFJ), which was announced late last year at the Los Angeles County Bar Foundation’s Gala. The Center joins LACBA’s other public service projects—Domestic Violence, Veterans, Immigration and AIDS Legal Services—as part of CFJ, which will focus on raising funds to support the projects. Last year alone, the projects combined to provide pro bono legal assistance to more than 23,000 people valued at more than $4.4 million. (more)



California Recognizes the In-Firm Attorney-Client Privilege 

The question of whether or not a law firm can assert an attorney-client privilege as to communications between the law firm and its attorneys relating to issues of ethics and/or risk management as against a current client has been an area of developing law throughout the United States. In California, the only guidance was in the form of a trio of federal court decisions appearing to find a very limited window permitting privileged communications in a federal case setting: Thelen, Sonic Blue, and E-Pass. The Thelen rule, however, remained confusing in application. On November 25, 2014, the California Court of Appeal in Edwards Wildman Palmer et al. v. Sup. Crt. (Mireskandari) answered question in the affirmative, joining Massachusetts, Georgia, and Oregon in recognizing an in-firm privilege and rejecting a fiduciary exception. (more)



Entering into a Business Pursuit with a Client May Result in No Coverage for Claims by That Client

Lawyers often find investments in client businesses attractive opportunities for making money. Lawyers need to be careful when investing in clients' companies, however, because malpractice claims arising out of the representation of the client in which the attorney (or even the attorney's spouse) has more than 10% equity position may not be covered under a specific exclusion in the malpractice policy.
