Los Angeles County Bar Foundation Celebrates More Than 50 Years of Community Service &
Foundation announces merger to become Counsel for Justice
The Los Angeles County Bar Foundation welcomed nearly 300 people to its Gala celebrating over 50 years of supporting legal public service in the community at the beautiful Bel Air Bay Club in Pacific Palisades on Thursday, October 23, 2014.
Guests enjoyed an elegant evening of gourmet hors d'oeuvres and cocktails, and helped raise funds to support the Foundation and Los Angeles County Bar Association’s (LACBA) public service projects: Domestic Violence, Veterans, Immigration Legal Assistance and AIDS Legal Services, as well as LACBA’s Center for Civic Mediation. Last year alone, the projects helped more than 23,000 people and provided over $4.4 million in pro bono legal services throughout Los Angeles County. (more)
Counsel for Justice: A Good Match for Cy Pres Awards from Unpaid Residuals in Class Action Litigation
As lawyers, our profession is dedicated to helping, defending, and speaking for others. I have little doubt that every one of us tries to leave this world a little better than we found it. One way I have discovered to integrate this noble goal with my class action practice is to utilize California Code of Civil Procedure Section 384, which allows residual funds in class action settlements that cannot be distributed to class members to be given to certain charitable organizations. LACBA's Counsel for Justice provides an incredible range of services to the community and is precisely the type of organization that courts look for in identifying a charitable recipient. (more)
Domestic Violence Project Assists Elder Abuse Petitioners through Direct Referrals from Court
LACBA’s Domestic Violence Project (DVP) handles petitions for temporary restraining orders involving elder abuse (EA), enabling our most vulnerable elderly population to often obtain help and a judicial decision all in the same day. “Los Angeles Superior Court refers EA petitioners directly to us,” said DVP Directing Attorney Debbie Kelly. "We can provide assistance and guidance through the filing process so that clients can receive the protection they are seeking.”

A Weekend in Legislation Camp: My Participation in the 2014 Conference of California Bar Associations
I left for the 2014 Conference of California Bar Associations (CCBA) on a warm September morning, visions of erudite discourse dancing in my head. The reasons I participate in LACBA's delegation are the people and an opportunity to debate policy rather than simply advocating on my clients' behalf. For the uninitiated, the CCBA is fast becoming one of the most effective lobbying groups in California, largely because its views are nonpartisan, and the conference is composed of attorney volunteers from across the state representing diverse backgrounds, experience, and expertise. That its delegates include such people as John Van de Kamp and James Brosnahan may help. (more)
Legal Ethics and Cloud Computing
Many ethics opinions have deemed cloud computing permissible when “reasonable,” but numerous data breaches and hacking incidents put confidential client information in the cloud at risk. Data breaches in California grew by 600% in 2013. Exchanges between the ABA and the U.S. National Security Agency (NSA) concerning the attorney-client privilege highlight the risk of government intrusion via technology. Device manufacturers improve encryption, which the government reportedly circumvents. Fourteen percent of law firms responding to an ABA survey experienced a data breach or theft. Preserve Confidential Information When Withdrawing from Representation
When a lawyer finds it necessary (or desirable) to withdraw from representing a client in a matter that is pending before a tribunal, a motion to leave to withdraw is usually required (unless the client has another lawyer substituting as counsel). An attorney's declaration in support of a withdrawal motion cannot compromise attorney-client confidentiality. But what happens if the client makes accusations about the lawyer in an objection to the motion or at a hearing on the motion? (more)
