LACBA Introduces New Immigration Legal Services and Veterans Legal Services Project Directors

Last month LACBA welcomed two new Project Directors for our Immigration and Veterans Legal Services Pro Bono Projects

Silvia_UpdateLeading our Immigration Project is Silvia Martinez. Ms. Martinez began her legal career as a staff attorney with San Pedro Community Legal Services.  She opened her own firm in 2008 and continued to practice exclusively in immigration law.  Ms. Martinez is also an active member of LACBA and has served on our Immigration Law Section’s Executive Committee.  In 2009 she was the recipient of the Honorable Benjamin Aranda III Outstanding Public Service Award for her community service with the LACBA’s Immigration Project.

Tara_updateLeading our Veterans Project please welcome Tara Hunter. Ms. Hunter has devoted most of her legal career to providing advocacy and representation to the underrepresented.  Prior to her work with the Project, Ms. Hunter worked to aid the families of victims of police misconduct, penning legal briefs that were critical in supporting claims for civil rights violations and the use of excessive force.  She received her JD from the University of San Diego, School of Law.

Immigration-Project-thumb Volunteers Needed: LACBA Immigration Pro Bono Representation Panel
For more than 20 years, LACBA’s Pro Bono Representation Panel volunteer attorneys have helped more than 4,000 immigrants remain in the United States with their families. Many persons in the Immigration Court are often represented by “notarios” and legal consultants who often deprive immigrants of their legal rights and benefits under the law. Attorneys can make a difference by volunteering their services for this worthwhile panel.

If you would like to participate, please join us for orientation on April 23, 2019. Remember Pro Bono representation is only for the first master calendar appearance. Immigration Court experience is preferred, but not necessary.

magnify_1115 Dating Your Co-Workers? Considering the Effect of Rule of Professional Conduct 1.8.10 for In-House Counsel

In 2018, California overhauled its Rules of Professional Conduct for the first time in decades. The new rules, which took effect on November 1, 2018, more closely align California's rules with the American Bar Association's Model Rules of Professional Conduct—and, in turn, with the many states that have modeled their rules on the ABA's. Among those new rules is Rule 1.8.10, which prohibits a lawyer from "engag[ing] in sexual relations with a current client who is not the lawyer's spouse or registered domestic partner, unless a consensual sexual relationship existed between them when the lawyer-client relationship commenced."

E&O_icon_1115 Do Not Give Advice When Declining to Represent a Prospective Client

When declining to take on a prospective client’s legal matter, some lawyers want to provide at least some assistance to the individual. Some lawyers might want to provide an opinion about the client’s legal matter. Either of these impulses should be resisted and no advice of any kind should be given to the rejected prospective client.
