Government Law
The Paperwork Reduction Act's bar on judicial review is narrow, prohibiting review only of cases that implicate a review of a decision by the Office of Management and Budget to approve or not act upon a collection of information contained in an agency rule. An action that consummated the OMB's decision-making process constituted a final agency action. OMB's determination as to whether a party must provide or disclose information to a government agency is not discretionary and it is therefore judicially reviewable under the Administrative Procedure Act. The OMB's determination of what appropriate remedial action should be taken is a matter of discretion that is not subject to judicial review.
