Environmental Law
The Clean Water Act allows the Environmental Protection Agency to require National Pollution Discharge Elimination permits for industrial storm water discharges, but the EPA has not exercised this authority. Since the CWA places no legal requirements on industrial stormwater discharges, there can be no inconsistent requirements with the Resource Conservation and Recovery Act.

Labor and Employment Law
The Railway Labor Act did not mandate arbitration of an employee's claim that he was entitled to a higher signing bonus from his employer under the Uniformed Services Employment and Reemployment Rights Act because his claim did not involve rights or duties created by a collective bargaining agreement. A trial judge properly evaluated whether it was "reasonably certain" that a worker would have attained a certain job status had he not left to serve in the military to determine his entitlement to a higher signing bonus where the employer provided signing bonuses based on job status. A signing bonus was a seniority-based benefit where the bonus is based, at least in part, on the worker's longevity in employment.
