Administrative Law
A "function standard" adopted by federal government agencies for sharing of terrorism-related information among law enforcement is a final agency action but it is exempt from the Administrative Procedure Act's notice and comment requirement because of the significant discretion retained by agencies and their analysts in determining whether to disseminate information, and it is not arbitrary or capricious.
