NINTH U.S. CIRCUIT COURT OF APPEALS
Constitutional Law
A constitutional challenge to California's 2011 and 2012 versions of the Low Carbon Fuel Standard were made moot by their repeal. The 2015 standard has the same core structure as the prior versions accepted as constitutional. The 2015 standard does not facially discriminate against interstate commerce in its treatment of ethanol and crude oil, nor does it purposefully discriminate against out-of-state ethanol.
