Proposed petition by income beneficiaries, alleging that trustees breached their fiduciary duty by favoring the remainder beneficiaries over the income beneficiaries with respect to distribution of income, would amount to a contest within the meaning of broadly worded no-contest clause where will establishing trust specifically authorizes trustees to make long-term investment decisions that may inure to the benefit of remainder beneficiaries at the expense of current income beneficiaries, and where there were no allegations of fraud, bad faith, or gross neglect on the part of the trustees.
