Brief Glimpse of My Second Year at the Conference of California Bar Associations: Back for More 
...As we settled in to debate the proposed resolutions, I was nervous. I had a resolution up for consideration in 2013. I drafted an amendment to the Election Code that brings more transparency to the ballot initiative process. My resolution was likely to be debated on the third of three conference days. I learned that while most of the delegations approved my resolution, there were a few that were against it or sought to amend it. I spent a lot of time the first two days strategizing how to ensure that my resolution would pass.    (more)   

Volunteering with LACBA's AIDS Legal Services Project 
My pro bono work has been immensely helpful in my private practice. I was able to obtain more direct and hands-on experience early on in my career. It is also nice to work with individual patients and beneficiaries. Since my private practice focuses on healthcare providers, which can range from individual physicians to large hospital chains, it is a good reminder that we are all working toward the goal of improving the lives of individual people.   (more)

Legal Ethics and Online Lawyer Referral Services 
Online lawyer referral services are proliferating, and lawyers receive frequent invitations to join them. The pertinent ethics considerations involve lawyer referral regulations, fee sharing, payment of referral fees, and advertising rules. Careful attention to the structure and status of lawyer referral services that are certified by the State Bar of California, online attorney-client Internet matching services, and directory groups before enrolling will assure that lawyers avoid ethical troubles.   (more)   

How to Use Your Opponents' Senses to Improve Your Position: Part Two, Soft or Hard 
In an experiment, participants sat in either a wooden chair or a cushioned chair while asked to negotiate for a new car with a sticker price of $16,500. Though chair hardness did not affect the size of participants' first offers, it did affect their willingness to raise their offers in a second round of haggling.   (more)   

Three Principles to Effectively Address an Error 
The practice of law is extraordinarily difficult, and while zero errors should be the goal, lawyers are (alas) human, and mistakes will be made. First and foremost, the absolute worst thing to do upon discovering an error is attempt to cover it up. Putting aside the strong ethical obligations, attempting to "smooth over" an error is a mistake that typically generates a separate cause of action (breach of fiduciary duty) that can be worse than the original malpractice.   (more)
