Trustees Vote to Support Proposition 34 
On September 27, 2012, the Los Angeles County Bar Association's Board of Trustees adopted a resolution in support of Proposition 34 on the November 2012 California ballot, which would modify death penalty convictions to life without the possibility of parole while not releasing any prisoners. The Board is not taking a position on the death penalty but sees Proposition 34 as an administration of justice issue where hundreds of millions of dollars saved from death penalty cases can be redirected to the court system. "The Neuroscience and Neuroeconomics of Decision Making: Implications for Mediation" Set for November 13 
The 7th Annual Robert I. Weil Lecture, “The Neuroscience and Neuroeconomics of Decision Making: Implications for Mediation,” will focus on imbedded processes that affect how decisions are made—often effectively but sometimes in self-defeating ways—and practical implications for lawyers and mediators. Together the speakers bring both the macro and microanalytical view to the study of human decision making. Their research helps us better understand the values and mechanisms underpinning individual and social decisions, as well as uncover how the crafting of appropriate systems and policies may bring about better decision making.   (more)  

Nominations Sought for Outstanding Jurist Award 
LACBA encourages our members to submit a nomination for LACBA’s Outstanding Jurist Award. Each year, the Board of Trustees selects the recipient from a confidential list of nominees submitted by an award committee. Established in 1979, the Outstanding Jurist Award, one of LACBA’s most prestigious awards, is presented annually to a current or past member of the federal or state judiciary in Los Angeles County. The award is viewed as recognition of a distinguished career on the bench as well as for contributions to the community and the practice of law.   (more)  

Casino Night: An Elegant Evening of Gaming, Cocktails, and Sumptuous Gourmet Offerings 
Actor John C. Reilly, whose credits include “Step Brothers” and “Walk Hard: The Dewey Cox Story,” was among those who enjoyed an exciting evening of casino gaming, drinks, and food at the Los Angeles County Bar Foundation’s 2nd Annual Casino Night on September 20, 2012, at the L.A. Athletic Club. This year’s event featured exciting new twists such as a silent auction of 16 items—including a four-night stay at a deluxe flat in the Montmartre district in the north of Paris near the Basilica Sacré-Cœur—and two wine basket collections from the wine cellars of Noah Graff, Los Angeles County Bar Foundation President, and Richard J. Ethics: Lawyer as Witness 
You are a California lawyer, and you represent a plaintiff in a breach of contract suit. You also have personal knowledge relevant to the dispute, as you overheard the defendant make a statement that supports your client’s position. Can you continue the representation, consistent with your ethical obligations? Can your adversary disqualify you? Would the analysis be different if you learn through discovery that your law partner overheard the defendant’s statement? The answers to these questions will be different depending on the nature of the case and the jurisdiction in which it is pending. In California, the answers are far from clear.   (more)  

Negotiation Tips: Understand Insurance Issues before Mediating  
Understanding insurance issues (coverage, limits, and consent) promotes communication focused on resolution. Knowing the status of the coverage encourages a realistic dialogue about trial direction, scope of defense, probability of collection, and settlement. Consider making insurance issues the first order of business at the mediation so as not to waste time.   (more)
