The Honorable Audrey B. Collins, Chief Judge of the U.S. District Court, Central District of California, has been selected as the recipient of LACBA's 2012 Outstanding Jurist Award. Judge Collins is being recognized for her exemplary service as chief judge of the largest federal trial court in the nation, her commitment to the Los Angeles community, her advocacy for victims' rights, and her role as a pioneer in the legal profession and on the bench by being the first woman of color appointed to several prominent positions.   (more)

State Bar of California MCLE Audit Alert 
The State Bar of California has commenced auditing lawyers' MCLE compliance. In 2012, the goal is to audit 5%, or approximately 3,000-4,000 lawyers, and in 2013, 10%, or 7000-8000 lawyers. Letters requesting proof of compliance for 2012 will be mailed in June. Read the letter from State Bar President Jon Streeter, and find out how LACBA can help members meet the requirements with several options for high-quality, low-cost CLE programming available in most substantive practice areas.   (more)

LACBA's Taxation Section has selected David Wheeler Newman as the recipient of its prestigious Dana Latham Award for lifetime achievement in the field of taxation law. He will be honored at the section’s annual Dana Latham Award Luncheon on Friday, June 1, at the Omni Los Angeles Hotel.   (more)  

Revisiting the Enforcement of Arbitration Clauses 
A recent 2011 decision addressed the law applicable to enforcement of arbitration clauses in retainer agreements and concluded in somewhat unique circumstances that a lawyer did not have a fiduciary duty to separately explain the clause to the clients where the language of the agreement was understandable and the clients simply failed to read it.   (more)

Studies by Bruce Barry and Raymond Friedman of Vanderbilt University's Owen Graduate School of Management suggest personality is less of a factor in negotiation than you might think. Their study concluded we believe toughness matters because of the "predictable and repeated errors we make when sizing up situations and processing information."   (more)
