LACBA Spearheads Effort to Provide Attorneys with Externship Opportunities on September 11
In an effort to address the unprecedented number of attorneys, recent law school graduates, and law students who have either lost their jobs or are currently unable to find employment in the law during these tough economic times, LACBA’s new Legal Public Service Corps seeks to bring together the skills of recent law school graduates and law students with the public sector and nonprofit organizations. LACBA Urges Federal Trade Commission to Exempt Lawyers from Red Flags Rule
LACBA, believing that Congress did not intend to consider lawyers as creditors, nor did it intend to regulate lawyers under the Red Flags Rule of the Fair and Accurate Credit Transactions Act of 2003, protested that compliance with the anti-fraud regulation would create a burden for LACBA members and that client information is already under the protection of ethical guidelines.   (more)   

Volunteer Mediators and Arbitrators Needed for Attorney-Client Mediation and Arbitration Services
ACMAS, administered by LACBA's Dispute Resolution Services, Inc., operates the highest volume fee dispute program in California. Volunteers are needed to hear each case and render an award in a timely manner so that both attorneys and clients can resolve their disputes and move on.   (more)

Ethics: Caperton v. Massey Coal Co.: Floodgates Opening or Stating the Obvious?
On June 8, the U.S. Supreme Court issued in a 5-4 decision its ruling in Caperton v. Massey Coal Co., holding that the federal due process clause can require that a judge who has been the beneficiary of substantial campaign-related financial contributions from a litigant recuse himself or herself from that litigant's case. Despite a vigorous dissent, it remains to be seen whether Caperton will actually matter much on the ground to lawyers or lower courts. Virtually every state already specifies in its code of judicial conduct or other statutes that when an objective observer would reasonably doubt the impartiality of a judge, recusal is required.   (more)
